Is it possible to obtain court approval for a marriage to an American man in Poland without him coming to Poland? The answer to this question is YES!
We have completed another case involving court approval for a marriage to a foreigner. This time, we faced a real challenge! We were commissioned to obtain court approval for the marriage of a Polish woman to an American man in one month! The wedding date had already been set, wedding planning agreements had been signed, and the American man’s family had already purchased plane tickets for the wedding.
An additional difficulty was that the American man resided in the US and, due to work commitments, could not be in Poland for the court hearing.
The United States does not issue the certificate required by the Polish Civil Registry Office. The U.S. Embassy and Consulate do not issue such a document either. In this situation, the American must obtain a Polish court order exempting them from submitting proof of legal capacity to enter into a marriage.
To obtain such an order, an application must be filed with the family court, duly justified, paid for, and the necessary documents attached, including the engaged couple’s birth certificates.
The rule is directness and open court proceedings. This means that the court must hear the case in a public hearing. In certain cases, the court may issue a ruling in closed session. This means that there is no hearing with the parties or their attorneys.
In a case seeking an order exempting an American man from submitting proof of legal capacity to enter into a marriage, the court must hear the engaged couple. The purpose of the hearing is for the court to assess whether there are any impediments to entering into a marriage. Such grounds may include incapacitation, mental illness, being left in a marital relationship, or a condition that precludes making an informed decision to enter into a marriage.
